Courts must take into consideration the wishes of a child only after the child is of "sufficient age and maturity." However, there is no set age when the child gets to call the shots. In general, the older the child is, the more likely the court will accede to the child's wishes. Also, the more reasoned this child's motive, the more likely the court will listen. For instance, if a child wants to stay with Dad because he lets the child stay up and play video games, the court will probably not take the child's wishes seriously. However, if Mom hurts the child when she loses her temper, the court will address the child's concerns.
